If upon expiration of the Term, the Leased Property does not comply with Section 9.1.4., Lessee shall, to the extent required by such Section at its expense, restore the Leased Property to the condition specified therein.

Lessee acknowledges and agrees that the Leased Property is the property of Lessor or Lessor has a leasehold interest in the Leased Property such that it is entitled to enter into this Lease, and that Lessee has only the right to the exclusive possession and use of the Leased Property upon the terms and conditions of this Lease. Lessee acknowledges and agrees that this Lease does not grant an option or any other type of right to purchase the Leased Property from Lessor.

Lessee acknowledges that the Leased Property is the property of Lessor and that Lessee has only the right to the exclusive possession and use of the Leased Property upon the terms and conditions of this Lease. Upon the expiration or earlier termination of this Lease Lessee shall, at its expense, repair and restore the Leased Property to the conditions required by Sections 9.1.1 and 9.1.4.

Except for federal, state and local income tax purposes with respect to which Lessee has been and shall continue to be deemed the owner of the Leased Property, Lessee acknowledges that the Leased Property is the property of Lessor and that Lessee has only the right to the possession and use of the Leased Property as a lessee of Lessor and upon and subject to the terms terms, provisions and conditions of this LeaseLease and the Existing Subleases.

Ownership of the Leased Property. Lessee acknowledges that the Leased Property is the property of Lessor and that Lessee has only the right to the possession and use of the Leased Property as a lessee of Lessor and upon and subject to the terms terms, provisions and conditions of this Lease, the Shasta Ground Lease and the Existing Subleases.

Lessee acknowledges that the Lessor owns the Land, that upon the construction of the Leased Property is Improvements, the property Lessor will own all of Lessor the Leased Property, and that Lessee has only the right to the possession and use of the Leased Property upon the terms and conditions of this Lease.
