Common use of Over Usage Clause in Contracts

Over Usage. In accordance with Section 5.5 of the Agreement, VECTRA reserves the right to perform true-up reconciliation and charge for any usage above the volume purchased. With respect to Detect for Network, to calculate End User’s usage, VECTRA will sample the amount of usage observed by any Product every hour. At the end of any 30-day period, the samples are ordered from highest to lowest. The top five percent (5%) of the samples are discarded.
