Limited Software Warranty. MyECheck represents, warrants, and covenants that: MyECheck warrants to the original end user (“Customer”), and not to subsequent end users, of the Extreme Networks software product (“Software”) that for ninety (90) days from the date of installation of the Software from MyECheck, the Software shall substantially conform with the specification for the Software at the (“Documentation”). MyECheck does not warrant (i) that the Software is error free, (ii) that Customer will be able to operate the Software without problems or interruptions or (iii) that the Software will be free of vulnerability to intrusion or attack. Except for the limited warranty set forth in this section, the Software is provided “AS IS.”

Limited Software Warranty. AVEVA warrants for a period of ninety (90) days following delivery of the Software that the Software will be free from material error that would substantially affect Customer’s Use of the Software. During the warranty period and without charge to Customer, AVEVA may: (i) replace defective media and/or (ii) use commercially reasonable efforts to provide modifications or fixes with respect to any material error in the Software in a reasonably timely manner (or provide Customer with alternative Software that does not contain the material error). However, if AVEVA is unable to make the Software operate as warranted and does not provide Customer with alternative Software, then AVEVA will refund the unused portion of the license fees paid to AVEVA for the defective Software and the license for such defective Software will terminate. This is Customer’s sole and exclusive remedy for a breach of this warranty. Notwithstanding the foregoing, this warranty shall not apply if such material error was caused or arises from: (i) Customer’s installation of the Software or misuse of the Software; (ii) modification or repair to the Software other than as expressly permitted by the Agreement; (iii) use or maintenance of the Software in a manner or environment inconsistent with the Documentation; (iv) anything Customer provides or designs including configurations, instructions, or specifications; or (v) the combination of the Software with a product, software, service, or technology not authorized by AVEVA.
Limited Software Warranty. OT warrants to Licensee that Software: (a) will be free of all known viruses at the time of first delivery; and (b) will perform substantially in accordance with its accompanying Documentation for 60 days from the date of first delivery. OT’s entire liability, and Licensee's sole remedy, for each breach by OT of the warranty in: (i) clause (a) is limited to requiring OT to deliver a replacement copy of the Software to Licensee free of known viruses; and (ii) clause (b) is limited to requiring OT to correct or work around the portion of the Software giving rise to such breach within a commercially reasonable time, failing which OT will refund all License Fees attributable to the portion of the Software giving rise to the breach.
Limited Software Warranty. If Buyer has purchased the software directly from Verso, then Verso warrants to Buyer that for a period of ninety (90) days (the "Software Warranty Period") beginning upon the date of shipment, the Software will substantially conform to its associated documentation when used in a computing environment (including on computer hardware and with operating systems) specified as "compatible" in the documentation. Verso's sole and exclusive obligation, and Buyer's sole and exclusive remedy, for breach of the foregoing warranty shall be, at Verso's option, to (a) correct any reproducible error in the Software; (b) replace the Software with a substantially equivalent substitute that conforms to the warranty set forth above; or (c) refund to Buyer the fees actually paid by Buyer to Verso for the non-conforming Software. THE EXPRESS WARRANTIES IN THIS SECTION 2 ARE IN LIEU OF ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, REGARDING THE PRODUCTS INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT OF THIRD-PARTY RIGHTS, QUIET ENJOYMENT, AND ACCURACY. NEITHER VERSO NOR ITS SUPPLIER REPRESENT OR WARRANT THAT THE OPERATION OF THE PRODUCTS (INCLUDING THE SOFTWARE) WILL BE UNINTERRUPTED OR ERROR-FREE. BUYER ACKNOWLEDGES THAT IT HAS RELIED ON NO WARRANTIES OTHER THAN THE EXPRESS WARRANTIES IN THIS SECTION 2 AND THAT NO WARRANTIES ARE MADE BY VERSO OR ANY OF ITS SUPPLIERS. Some jurisdictions do not allow the disclaimer of implied warranties, so the above disclaimer of implied warranties may not apply to Buyer, in which case the duration of the implied warranties is sixty (60) days from when the Product is received by Buyer.
Limited Software Warranty. AnyLogic only warrants that the Software will perform substantially as set forth in the Documentation within 90 days from the date on which Licensee is granted a license so long as no modifications have been made to the Software. If the Software fails to substantially perform within the first 90 days, Licensee will be entitled to a replacement or a refund. AnyLogic makes no other warranties with respect to the Software.
Limited Software Warranty. D-Link warrants that the software portion of the product (“Software”) will substantially conform to D-Link’s then current functional specifications for the Software, as set forth in the applicable documentation, from the date of original retail purchase of the Software for a period of ninety (90) days (“Warranty Period”), provided that the Software is properly installed on approved hardware and operated as contemplated in its documentation. D-Link further warrants that, during the Warranty Period, the magnetic media on which D-Link delivers the Software will be free of physical defects. D-Link’s sole obligation shall be to replace the non-conforming Software (or defective media) with software that substantially conforms to D-Link’s functional specifications for the Software or to refund at D-Link’s sole discretion. Except as otherwise agreed by D-Link in writing, the replacement Software is provided only to the original licensee, and is subject to the terms and conditions of the license granted by D-
Limited Software Warranty. For a period of forty-five (45) days from the License Term start date set forth on the applicable Order Form (“Software Warranty Period”), Delphix warrants that, under normal authorized use: (a) the Software will substantially conform to the functional specifications set forth in the Documentation; and (b) it has used commercially reasonable efforts in accordance with industry standards to screen the Software, and to its knowledge, the Software, as delivered, does not contain any virus, Trojan horse, or trap door.

Limited Software Warranty. CYBERBIT WARRANTS THAT THE ORIGINAL COPY OF THE SOFTWARE ON THE MEDIA ON WHICH IT IS FURNISHED SHALL SUBSTANTIALLY CONFORM TO ITS PRODUCT DESCRIPTION, AS IT EXISTS AT THE DATE OF DELIVERY OF THE SOFTWARE, AND FOR A PERIOD OF NINETY (90) DAYS THEREAFTER. CYBERBIT’S ENTIRE LIABILITY, AND YOUR EXCLUSIVE REMEDY, UNDER THIS WARRANTY SHALL BE, AT CYBERBIT’S OPTION, EITHER: (I) RETURN OF THE CONSIDERATION ACTUALLY PAID TO CYBERBIT FOR THE PRODUCT, WHICH SHALL RESULT IN THE TERMINATION OF APPLICABLE PURCHASE ORDER AND THIS AGREEMENT; OR (II) REPAIR OR REPLACEMENT OF THE PRODUCT OR MEDIA THAT DOES NOT MEET THIS LIMITED WARRANTY. Following the lapse of the warranty period set forth in this Section above or the warranty period in the SLA, as the case may be, Cyberbit, its licensors and Affiliates have no obligation to provide You with any service, including but not limited to, technical support, maintenance, upgrades, modifications, or new releases. Any purchases of services, upgrades or new releases shall be subject to this Agreement, unless otherwise indicated by Cyberbit.
Limited Software Warranty. OT warrants to Licensee that the Software at the time of first delivery to Licensee: (a) will be free of all known viruses; and (b) will be free from defects as to quality and title.
Limited Software Warranty. For a period of 90 days after the Software is first made available to Customer and as initially delivered, Viewpoint warrants that the Software will perform substantially in accordance with the Documentation. In the event that the Software does not meet this warranty, Customer must notify Viewpoint within 10 days of the issue and provide Viewpoint with sufficient detail to allow Viewpoint to reproduce the issue. As Customer’s sole and exclusive remedy for any breach of this warranty, and as Viewpoint’s entire liability in contract, tort, or otherwise with respect to such warranty, Viewpoint will correct such breach by issuing corrected instructions, a restriction, or a bypass, or by replacing the Software. This warranty shall not apply if the Software is provided for beta, trial, testing, or evaluation purposes for which Viewpoint does not receive any Fees or if a breach of this warranty is caused by (a) third party software or services (including in combination with the Software) not provided by Viewpoint; (b) modifications to the Software, other than upgrades or updates provided by Viewpoint; (c) unauthorized use or use of the Software other than in accordance with the Order, this Agreement, and the Documentation; or (d) viruses introduced by Customer or its agents or Users.
