Common use of OUT PAY Clause in Contracts

OUT PAY. In cases where off-duty employees are called out to assist in an emergency, they shall receive a minimum of two hours pay for each emergency call-out and will be compensated at the rate of time and one-half for time worked on a portal-to-portal basis. If the employee is called back on a holiday or while on authorized paid leave, he shall be paid in accordance with the rule shown above and receive the equivalent hours off to replace the hours worked on the holiday or leave pay on a straight time basis. Any employee who is on duty and is instructed and assigned to return to work shall be ineligible for call-out pay but may be eligible for compensation at the overtime rate of pay. Any employee required to continue working after completion of their regular scheduled shift shall be ineligible for call-out pay but may be eligible for compensation at the overtime rate of pay.
