OPERATIONAL CHANGE. (a) If, during the life of this Agreement, the Company wishes to make an operational change in its operations which would have the effect of abolishing existing job classifications or creating new job classifications or which would result in the lay-off of any regular employee, the Company agrees that, before introducing such operational change, it will meet with the Union to discuss the matter and to attempt to resolve the problems created by such operational change, as well as to attempt to lessen the impact of such operational change on the employees affected.
(b) If, as a result of an operational change in the Company's operations, an employee is assigned to a job having a lower rate of pay than the rate of pay that the employee formerly received, the employee shall continue to be paid at their former rate of pay until the job rate for the new classification equals the employee’s former rate.
(c) If a regular employee should be displaced from the employee’s job by reason of an operational change in the Company's operations, and provided the employee has the necessary qualifications to perform the work available after a reasonable training period, the Company shall arrange, where feasible, for the employee to receive such training.
(d) In the event that an employee is to be permanently laid off as a result of operational change, that employee will receive one week's notice of layoff for each full year of service completed. An employee given notice under this provision may:
(i) Elect to receive severance pay in lieu of such notice, in accordance with the severance arrangement contained herein, in which event the employee shall thereupon cease to be an "employee" under this Agreement and the employee’s name shall be removed from the seniority list;
(ii) Elect to go on lay-off at the conclusion of the required period of notice and to retain their rights of recall as provided for by clause 8.02(b) hereof. The notice, or pay in lieu thereof, as provided for herein shall be deemed to be inclusive of any period of notice or pay in lieu thereof, which may be held to be due to the employee under the Employment Standards Code of Alberta or any other applicable law or regulation thereunder.
17.02 Where, during the life of this Collective Agreement, changes in the Company’s operations are required which cause the permanent layoff of full-time bargaining unit employees, the following severance arrangements shall apply:

OPERATIONAL CHANGE. The Employees agree that the Employer has the right to study, introduce or implement new or improved methods, facilities or equipment. Where the introduction of a technological change or a reorganization in the Department will result in the loss of employment, lay-off or demotion of employees, the Employer will:
OPERATIONAL CHANGE. 26.1 The Employer agrees to provide as much advance notice as is reasonably practicable, but not less than three (3) months' notice, to the Union of a technological change in equipment or methods which would result in a change in employment status or a significant change in working conditions of employees as provided for in this Agreement. In addition, the Employer agrees to meet with the Union with the view to discussing problems which might arise as a result of the introduction of such technological change.
26.2 In the event of technological change or other change causing job elimination, the Employer will seek ways and means of minimizing adverse effects on employees which might result from such change.
26.3 Where the Employer determines that the appropriate response to a technological change is employee retraining and that such training is reasonably feasible, it shall be provided during normal work hours where possible.
26.4 Where the Employer determines that there are redundant positions resulting from operational change those regular full-time employees who are laid off or terminated will be provided with a severance package which will pay four (4) weeks pay for each year of service to a maximum of fifty-two (52) weeks. On production of receipts from an authorized educational institution or employment counseling firm, regular full-time employees shall be entitled to reimbursement of up to five thousand dollars ($5,000.00) as an employment transition allowance or up to five thousand dollars ($5,000.00) as a relocation allowance. To be eligible for reimbursement, receipts must be received within twelve (12) months from the date of layoff or termination.
OPERATIONAL CHANGE. 19.1. The Employees agree that the Employer has the right to study, introduce or implement new or improved methods, facilities or equipment. Where the introduction of a technological change or a reorganization in Waterloo Fire Rescue will result in the loss of employment, lay-off or demotion of employees, the Employer will:
a) Notify the Association in writing of its intention to implement such change or changes at least sixty (60) days prior to their introduction. Such notice shall contain:
i) The nature and degree of change,
ii) The date or dates on which the Employer plans to effect the change(s),
iii) The location(s) involved,
iv) The effects of the change(s) on each classification of employee.
b) Following said notice, the Employer will meet with representatives of the Employees, as soon as practical, but in any event not later than thirty (30) days prior to the date of implementation, to discuss fully the implications of the change(s).
c) In the event the change to be implemented is a “technological change” and would result in the loss of employment or lay-off of any employee, the Employer agrees that without mutual agreement, no employee covered by this Agreement, save and except probationary employees, shall suffer loss of employment, provided the employee was in the employ of the Corporation at the time the aforementioned notice was given by the Employer.
19.2. The words, “technological change” in this Article mean:
a) The introduction by the Employer of new equipment or material or equipment or material of a different nature or kind than previously utilized; and,
b) A change in the manner in which the Employer carries on its work and undertaking that is directly related to the introduction of that equipment or material.
OPERATIONAL CHANGE. 3.1 The Parties may agree Operational Changes, via the Operational Change Process agreed between the parties from time to time in writing.
3.2 Operational Changes shall be used to agree amendments to the terms of any Service Order, provided any Charges related to such amendments are in accordance with the provisions of Schedule 5 (Charges).
3.3 An Operational Change is agreed when it has been approved by both parties in accordance with the Operational Change Process.
3.4 Either party may require that a change that has been presented as an Operational Change is re-classified as a Change which shall be agreed via the process set out in paragraph 2 above where:
3.4.1 the parties cannot agree the terms of such Operational Change;
3.4.2 where it is not possible to agree the Operational Change within a reasonable timeframe; or
3.4.3 where such change is not in the reasonable opinion of that party an Operational Change, including for the avoidance of doubt where it constitutes a change to this Agreement, requires a change to the Charges or otherwise changes the Services, Operational Measures or Super KPI. Accordingly, Operational Change requests may only be invoked in relation to matters which are catered for within the Charges for the Services. INTERNAL 3.4.4

OPERATIONAL CHANGE. 27.1 The Corporation is aware of the importance of job security to its employees and will discuss a minimum of three (3) months in advance with the Executive Officers of the Union any change in its operation which could cause a loss of security of employment. The objective of such joint discussion will be the continued employment of those employees affected and avoidance, if possible, of a layoff situation occurring.

OPERATIONAL CHANGE.
