Operation & Maintenance. Developer shall, at its own expense, operate and maintain, interconnecting equipment (as described in 2.1) on the Developer's side of the interconnect point. Developer may not modify or replace the interconnection equipment described in D2.1 above without the prior written consent of Utility.

Stryker’s Services are ancillary to and not a complete substitute for the requirements of Customer to adhere to the routine maintenance instructions provided by Stryker, it’s Equipment and operations manuals, and accompanying labels and/or inserts for each item of Equipment. Customer’s appropriate user personnel should be entirely familiar with the instructions and contents of those manuals, labels and inserts and implement them accordingly.

For this purpose, he will submit detailed Operation and Maintainance plan to the Authority for approval. & Concessionaire shall depute (at his cost) adequate team of people OR expertise agency for these works. The credentials & experience of these would be verified by the Authority before approval.

Site User agrees to (1) operate and maintain the Equipment at the Facility in a careful and proper manner and as a reasonably prudent operator and will diligently adhere to all procedures, instructions, specifications and guidelines provided by DB or contained in the Documentation, (2) comply with all federal, state, municipal, and other laws, regulations and ordinances relating to possession, operation or maintenance of the Equipment and the Licensed Technology, (3) maintain the Equipment, at Site User's cost and expense, in good operating order, repair, condition and appearance, and perform all required preventative maintenance on the Equipment, and (4) keep, locate and store the Equipment in a safe, secure and suitable environment at the Facility and protect it from deterioration (other than normal and expected wear and tear resulting from proper operation of the Equipment) and damage, loss or destruction.
