Operating Payment Sample Clauses

Operating Payment. Commencing on the Rent Commencement Date, for each Lease Year after the Base Lease Year, Tenant shall pay to Landlord in accordance with Sections 4.04, 4.05 and 4.07 below (“Tenant’s Operating Payment”), Tenant’s Operating Share of the amount, if any, by which Operating Expenses for such Lease Year exceed the Base Operating Amount.

Operating Payment. For each Rent Year (or portion thereof) during the Term, Tenant shall pay Landlord, as Additional Rent, Tenant's Share of Operating Expenses (the "Operating Payment") in the manner set forth in Section 4(B). “Operating Expenses” shall include (i) Impositions, (ii) Property Expenses, and (iii) Insurance Expenses. For purposes hereof, the following terms shall have the following meanings:

Operating Payment. Tenant shall pay Landlord, as Additional Rental, an Operating Payment in an amount equal to Tenant's Proportionate Share of the excess of (i) Operating Expenses for each calendar year, over the (ii) Base Year (as defined in Section 1.1.J.), which Operating Payment shall be paid by Tenant in monthly installments in such amounts as are estimated and billed by Landlord, each installment being due in advance on the first day of each calendar month. Within one hundred twenty (120) days, or a reasonable time thereafter (in Landlord's determination), after the end of each calendar year Landlord shall deliver to Tenant a statement of Operating Expenses for such calendar year and the monthly installments paid or payable shall be adjusted between Landlord and Tenant, and each party hereby agrees that Tenant shall pay Landlord or Landlord shall credit Tenant's account (or, if such adjustment is at the end of the Term, reimburse Tenant), within thirty (30) days of receipt of such statement, the amount of any excess or deficiency in Operating Payment paid by Tenant to Landlord during such calendar year. Upon reasonable notice, Landlord shall make available for Tenant's inspection at Landlord's office, during normal business hours, Landlord's records relating to the Operating Expense for such preceding calendar year. Failure of Landlord to provide the statement called for hereunder within the time prescribed shall not relieve Tenant from its obligations hereunder.

Operating Payment. For each Lease Year after the Base Lease Year, Tenant shall pay to Landlord in accordance with Sections 4.04, 4.05 and 4.07 below (“Tenant’s Operating Payment”), Tenant’s Proportionate Operating Share of the amount, if any, by which Operating Expenses for such Lease Year exceed the Base Operating Amount.

Operating Payment. Tenant shall pay to Landlord, as Additional Rent, the product of (i) the amount of Operating Expenses for the Office Building on a per rentable square foot basis and (ii) the number of rentable square feet in the Premises as specified in Section 1.1(S) hereof, as the same may be modified pursuant to Section 1.2(A) (the "Operating Payment"). For purposes of this Lease, the rentable square footage of the Office Building shall equal 1,277,605 rentable square feet. The Operating Payment shall be made pursuant to the provisions of Section 3.2 hereof; provided, however, that Tenant shall not be required to pay for the Operating Payment attributable to the first twenty-two (22) months of the Term beginning on the Commencement Date. In the event the rentable square feet of the Premises is changed pursuant to a specific provision of this Lease, item (ii), above, shall be appropriately adjusted, and, as to the year in which such change occurs, the rentable square feet for the Premises for such year shall be determined on the basis of the number of days during such year that each such rentable square footage was in effect.

Operating Payment. 2.1 Owner shall pay to Operator a monthly operating payment for operation of the Facilities in an amount as set forth below: A) A Base Operating Charge per month of: $2,500.00 B) Additional monthly charges pursuant to Exhibit B C) Any actual third party cost incurred by Operator during the previous month’s operation of the Facilities pursuant to Section 3.3 of this agreement. 2.2 All operating payments shall be due and payable within 30 days of Owner’s receipt of Operator’s invoice for charges under 2.1 above. 2.3 To the extent Owner fails to make payments by such date, the operating payments due and payable shall be increased by one percent (1%) of the unpaid balance due each month.

Operating Payment. 2.1 Owner shall pay to Operator a monthly management payment for the implementation and management of D.A. compliance in the amount as set forth below: A. Base Monthly Operating Charge: i) Period May 1, 2010 through April 30, 2015 $ 500.00/ Mo. B. In the event some of the duties and responsibilities are transferred from Operator to Owner, both parties agree to modify the Base Monthly Operating Charge paid by Owner to Operator, pursuant to the Agreement, to a rate mutually agreeable to both parties. Transfer of responsibilities shall require Operator’s approval based on Owner’s ability to competently perform such responsibilities. C. Any incidental D.A. costs such as test site fees, consortium processing fees or other D.A. testing related fees, shall be paid by Owner. D. Any costs related to D.A. employee rehabilitation, return to duty and follow up testing shall be paid by Owner. 2.2 All operating payments shall be due and payable within thirty (30) days of Owner’s receipt of Operator’s invoice. Operating Payment. For each Lease Year or portion thereof commencing on or after July 1, 2016, Tenant shall pay to Landlord in accordance with Sections 4.04, 4.05 and 4.07 below (“Tenant’s Operating Payment”), Tenant’s Operating Share of the amount, if any, by which Operating Expenses for such Lease Year exceed the Base Operating Amount.
