Notification Regarding Modifications. If any additions, modifications or replacements undertaken by Customer would reasonably be expected to affect GEM’s ability to satisfy its obligations under this Agreement, Customer shall notify GEM in writing ninety (90) days in advance of undertaking such additions, modifications or replacements (unless Good Utility Practice requires Customer to undertake such additions, modifications or replacements prior to the expiration of the ninety (90) day period, in which case Customer shall provide GEM such advance written notice as is reasonably practicable under the circumstances) and shall conduct work at mutually agreeable times.
Notification Regarding Modifications. If any additions, modifications, or replacements of the GEM Technology might reasonably be expected to negatively affect the operation of the Customer Facility, GEM shall provide ninety (90) days’ written notice to Customer prior to undertaking any such additions, modifications, or replacements (unless Good Utility Practice requires GEM to undertake such additions or modifications prior to the expiration of the ninety (90) day period, in which case GEM shall provide Customer such advance written notice as is reasonably practicable under the circumstances) and conduct such work at mutually agreeable times. If Customer objects to such additions, modifications, or replacements Customer must request a mitigation plan from the Transmission System Operator Services Committee. If the Transmission System Operator Services Committee has not unanimously reached an agreement on the mitigation plan within thirty (30) days, (i) GEM may at its sole discretion proceed at its expense with the addition, modification or replacement required due to a material change to applicable Governmental Rules or (ii) terminate this Agreement, prior to the effective date of the applicable Governmental Rule, NERC or Regional Entity standards.
Notification Regarding Modifications. OpenSite shall provide Business Partner with advance notification of new releases and updates, including Updates and Enhancements, that affect the use of the Software by End-Users. Such advance notification shall be given to Business Partner as soon as practicable.
