Notice and Filing of Requests. 5.1.1 Any request by the Consultant for additional fees or expenses shall be made in writing to the State and filed prior to payment of the final five percent of the Basic Fee. The Consultant’s failure to comply with the requirements of this Section 5.1.1 shall constitute an irrevocable waiver by the Consultant of any request for such fees and expenses.
