SAP and its licensors will not be responsible under this Agreement (i) if the Software is not used in accordance with the Documentation; or (ii) if the defect is caused by Provider or Customer, a Modification or Add-on, third- party software, or third party database. SAP AND ITS LICENSORS SHALL NOT BE LIABLE FOR ANY CLAIMS OR DAMAGES ARISING FROM INHERENTLY DANGEROUS USE OF: (a) THE SOFTWARE AND/OR (b) THIRD-PARTY SOFTWARE LICENSED HEREUNDER.

SAP and its licensors will not be responsible under this Agreement unless otherwise agreed to in writing by the parties to the extent that the Software (i) if the Software is not used in accordance with the Documentation; or (ii) if the defect is caused by Provider or CustomerLicensee, a Modification or AddModification, third-on, third- party softwaresoftware not imbedded in the Software, or third party database. SAP AND ITS LICENSORS SHALL NOT BE LIABLE FOR ANY CLAIMS OR DAMAGES ARISING FROM INHERENTLY DANGEROUS USE OF: (a) OF THE SOFTWARE AND/OR (b) THIRD-PARTY SOFTWARE LICENSED HEREUNDER.
