Non-Transferable Privileges. Commuter Passenger Capacity authorized by Section 4.05 in this LICENSE and the Access Plan are not property interests of the LICENSEE and are non-transferable in any form, and as such, are not subject to sale, assignment, hypothecation, and transfer, by the LICENSEE under the terms of this Section. Any such attempted assignment, sale or other such attempted transfer of operations, privileges or Commuter Passenger Capacity is in violation of the public policy of the COUNTY and shall be void and shall constitute a breach and default of this LICENSE.
