Non-Submitting Program Claimant. A Non-Submitting Program Claimant immediately shall cease to have any further rights under the Program, but such Program Claimant’s Release and Dismissal Stipulation shall be delivered to Merck and, without limitation, Merck shall be free to file or cause to be filed such Dismissal with Prejudice Stipulation and/or Release, in any relevant action or proceeding.
