Non-Exempt. A term used to describe employees who are subject to the minimum wage and overtime standards of the Fair Labor Standards Act (FLSA), are paid for hours worked, and who must be paid one-and-one- half (1 ½) times their regular rate of pay for excess hours worked. Occupational Disease/Illness. Condition or disease arising out of, and in the course of, employment. Occupational Safety and Health Administration (OSHA). A federal agency created in 1970 to establish health and safety standards for the workplace and to ensure that all U.S. workers have a safe, healthy work environment.
