Common use of NOAA Clause in Contracts

NOAA. 1. The legal authority for MBNMS to enter into this Agreement is the National Marine Sanctuaries Act (NMSA), 16 U.S.C. 1431 et seq., specifically 16 U.S.C. 1442(a), which allows the Secretary to enter into cooperative agreements, contracts, or other agreements with, or make grants to, States, local governments, regional agencies, interstate agencies, or other persons to carry out the purposes and policies of the NMSA. 2. The programmatic authority for MBNMS to enter into this Agreement is the NMSA, which includes among its purposes and policies the following (subparagraphs 1, 2, 3, 6, and ▇ ▇▇ ▇▇ ▇.▇.▇ ▇▇▇▇(▇)): (1) to identify and designate as national marine sanctuaries areas of the marine environment which are of special national significance and to manage these areas as the National Marine Sanctuary System;
