No Waiver of Sovereign Immunity by County. Notwithstanding any other provision of this Amended and Restated Deed of Trust to the contrary, nothing in this Amended and Restated Deed of Trust nor any action taken by County pursuant to this Amended and Restated Deed of Trust nor any document which arises out of this Amended and Restated Deed of Trust shall constitute or be construed as a waiver of either the sovereign immunity or governmental immunity of County, or of its elected and appointed officials, officers and employees.
