Common use of No Mitigation or Offset Clause in Contracts

No Mitigation or Offset. Executive shall not be required to mitigate the amount of any payment provided for in Section 5 or Section 6 of this Agreement by seeking other employment or otherwise. The Company shall not be entitled to set off or reduce any severance payments owed to Executive under this Agreement by the amount of earnings or benefits received by Executive in future employment.

No Mitigation or Offset. The Executive shall not be required to mitigate the amount of any payment provided for in this Section 5 or Section 6 of this Agreement 5.4 by seeking other employment or otherwise. The Company , nor shall not be entitled to set off or reduce any severance payments owed to Executive under this Agreement by the amount of earnings any payment provided for in this Section 5.4 be reduced by any compensation earned by the Executive as the result of employment by another employer or benefits received business or by profits earned by the Executive in future employmentfrom any other source at any time before and after the Date of Termination.

The Company Employer shall not be entitled to set off or reduce any severance payments owed to Executive under this Agreement Section 7 by the amount of earnings or benefits received by Executive in future employment.

The Company , and no such payment shall not be entitled to set off offset or reduce any severance payments owed to Executive under this Agreement reduced by the amount of earnings any compensation or benefits received provided to or earned or generated by Executive in future employmentor from any alternate employment or endeavors.

Except as provided in Sections 5(a)(ii) and 5(b)(ii) hereof, the Executive shall not be required to mitigate the amount of any payment provided for in Section 5 or Section 6 of this Agreement by seeking seek other employment or otherwiseto reduce any severance benefit payable under this Section 5, and, no such severance benefit shall be reduced on account of any compensation received by the Executive from other employment. The Company Company's obligation to pay severance benefits under this Agreement shall not be entitled to set off or reduce reduced by any severance payments amount owed to Executive under this Agreement by the amount of earnings or benefits received by Executive in future employmentto the Company.

The Company otherwise to mitigate damages as a condition to the receipt of the severance benefits described in this Section 5.5, and such benefits shall not be entitled to set off reduced or reduce offset by any severance payments owed to Executive under this Agreement by the amount of earnings or benefits received by Executive from any other source except as set forth in future employmentSection 5.5(c) of this Agreement.
