No Liens; Bonds. PMB understands and acknowledges that, as property owned by a home rule municipality, a valid lien cannot attach to the East Park Property to secure the payment of the cost of labor and materials related to the construction of the East Park Improvements on the East Park Property. PMB shall require its contractor to obtain payment and performance bonds in the amount of the costs for construction of the East Park Improvements in compliance with Chapter 2253, Texas Government Code, as amended, with both PMB and City as owners for purpose of the construction of the East Park Improvements.
