The NMS (Non-Manipulation of Market Securities) clause is designed to prohibit parties from engaging in activities that could artificially influence the price or trading volume of securities. In practice, this clause restricts actions such as spreading false information, executing trades with the intent to mislead the market, or coordinating with others to manipulate market outcomes. Its core function is to maintain fair and orderly markets by preventing manipulative practices that could harm investors or undermine market integrity.

NMS. A. Ss 58-6-5. Borrower represents and warrants that it is aware of and through its duly authorized officers and/or authorized representatives, has read and understands the provisions of N.M.S.A. Ss 58-6-5 which provides: "A contract, promise or commitment to loan money or to grant, extend or renew credit or any modification thereof, in an amount greater than twenty-five thousand dollars ($25, 000), not primarily for personal, family or household purposes, made by a financial institution shall not be enforceable unless in writing and signed by the party to be charged or that party's authorized representative.... "
NMS. The use of XML messages for configuration of the NEs is growing more common due to its well- structured and self-documenting nature, and the ability to add new features without losing compatibility. The structure of a XML document is defined by a schema [W3SCHEMA]. Schemas are usually proprietary, but there have been some standardization attempts regarding the transport protocol and the message formats, such as the Network Configuration Protocol (NETCONF) RFC 6241 [RFC6241], the Simple Object Access Protocol (SOAP) [SOAP] or the Representational State Transfer (REST) [REST] .

NMS. (a) Notwithstanding any provision to the contrary contained in this Agreement, Northwestern shall not permit NMS to carry out, conduct, perform, undertake or fulfill any of covenant or obligation of Northwestern under this Agreement that NMS is entitled to carry out, conduct, perform, undertake or fulfill in accordance with the terms of this Agreement, or permit NMS to enforce any rights granted to Northwestern under this Agreement, including the right to maintain and exercise the Option, unless: (i) NMS is duly incorporated, organized and in good standing during the term of this Agreement under all applicable Mexican laws (including Mexican Official Standards and Non-Official Standards); and (ii) NMS is and remains during the term of this Agreement an Affiliate of Northwestern. (b) Upon the due incorporation of NMS, Northwestern shall cause NMS to agree in writing in favour of Minera Tango and Yamana to be bound by the terms of this Agreement. (c) Northwestern hereby agrees that it shall remain jointly and severally liable for any and all Losses incurred or suffered by Minera Tango or Yamana resulting from any act or omission of NMS arising out of or in connection with this Agreement.
NMS. CenturyLink will respond to all identified incidents according to the table above, after ticket generation. Customer’s designated incident contact will be notified by telephone and email for High severity incidents and via e-mail for Severity Medium, Low and MACD incidents. During a High severity incident escalation, CenturyLink will contact the designated Customer contact until all escalation contacts have been exhausted. Incidents will be posted to the Service portal near real time upon identification. Operational activities related to incidents and responses are documented and time-stamped within the CenturyLink trouble ticketing system, which will be used as the sole authoritative information source for purposes of this SLA. d. Policy change request acknowledgement SLA. CenturyLink will acknowledge receipt of Customer’s policy change request e. Customer service request implementation SLA.

  • Nasdaq National Market The Common Stock is registered pursuant to Section 12(b) of the Exchange Act and is listed on the Nasdaq National Market ("Nasdaq"), and, except as contemplated by this Agreement, the Company has taken no action designed to, or likely to have the effect of, terminating the registration of the Common Stock under the Exchange Act or delisting the Common Stock from Nasdaq, nor has the Company received any notification that the SEC or the National Association of Securities Dealers, Inc. ("NASD") is contemplating terminating such registration or listing.

  • Nasdaq Stock Market The Public Securities have been authorized for listing, subject to official notice of issuance and evidence of satisfactory distribution, on The Nasdaq Stock Market (the “Nasdaq”), and the Company knows of no reason or set of facts that is likely to adversely affect such authorization.

  • Bulletin Boards The Employer shall provide bulletin board facilities for the exclusive use of the Union, the sites to be determined by mutual agreement. The use of such bulletin board facilities shall be restricted to the business affairs of the Union.

  • Bulletin Board The Employer shall provide a bulletin board which shall be placed so that all employees will have access to it and upon which the Union shall have the right to post notices of regular meetings, special meetings, seminars or Union activities.

  • Union Bulletin Boards The Employer agrees to furnish and maintain suitable bulletin boards in convenient places. The Union shall limit its posting to official notices and bulletins of the Union to such bulletin boards.
