Necessary effect Sample Clauses

Necessary effect. The concept of necessary effect is important as it is intrinsically linked to the idea of legal presumptions of harmful effects under the object heading.23 Necessary effect is based on the assertion that under the object heading the concrete effects of an agreement do not need to be considered, as certain restrictions of competition automatically infringe Article 101(1) TFEU due to their known negative effects on competition.24 This is derived from experience. As such, there is a presumption of anti-competitiveness as agreements have the inevitable consequence of restricting competition.25 Presumptions of harm play a key role within the orthodox approach and the desire to make comparisons with the US is therefore understandable.
