Nature of Payment Obligation; No Acceleration. The obligation of the District to pay Leaseback Payments pursuant to this LBA shall constitute a current expense of the District. Nothing in this LBA shall be deemed or construed to constitute: (i) debt of the District in contravention of any applicable constitutional or statutory limitations; or (ii) a pledge of the general tax revenues, funds or moneys of the District. Notwithstanding anything to the contrary, in no event shall the Contractor have the right to require accelerated payment of any Leaseback Payment that is not then due or in default, or to otherwise declare any such payment immediately due and payable.

  • Repayment Obligation In the event that any State and/or federal funds are deferred and/or disallowed as a result of any audits or expended in violation of the laws applicable to the expenditure of such funds, the Contractor shall be liable to the Agency for the full amount of any claim disallowed and for all related penalties incurred. The requirements of this paragraph shall apply to the Contractor as well as any subcontractors.

  • Notice of Payment of Termination Payment As soon as practicable after a liquidation, Notice shall be given by the Non-Defaulting Party to the Defaulting Party of the amount of the Termination Payment and whether the Termination Payment is due to the Non-Defaulting Party. The Notice shall include a written statement explaining in reasonable detail the calculation of such amount and the sources for such calculation.
