Common use of Monitoring by the Department Clause in Contracts

Monitoring by the Department. Without limiting any other rights which the Department might have, the Department will monitor in relation to a Restart Payment, the Provider’s payment and claims for Reimbursement of amounts paid in accordance with this Agreement and any Guidelines. The Provider acknowledges and agrees that: an unethical manner for the purposes of clause 28.1(a) of this Agreement includes any practice that: involves inappropriately paying a Restart Payment; misuses or misappropriates a Restart Payment; and the practices described in clause 586.1(a) may result in the Department taking the action set out in clause 302 [Remedies for breach]. The Provider must do all things necessary to ensure that: all payments to third parties with monies paid for a Restart Payment are authorised and made in accordance with this Agreement and any Guidelines; and it maintains proper and diligent control over the incurring of all liabilities.
