Common use of Minimum Use Clause in Contracts

Minimum Use. Each employee shall take not less than one third of the leave accrued during the period beginning with the first day of the first pay period in January and ending with the last day of the pay period occurring fifty-two weeks later. An employee shall be exempt from the minimum use requirement to the extent that such use would cause the employee’s personal leave balance to be less than 348 hours (for 24/48 hour regular duty shifts) or thirty days (for 37.5 hour workweeks). Cash in and transfer of leave is not counted towards minimum leave use.
