Minimum Quantity. Dealer will not be required to stock a minimum quantity of the Products for the first two years of this Agreement. ASTI shall ship the Products directly to Dealer's customers or to Dealer FOB ASTI's warehouse

Minimum Quantity. If an order is less than the minimum order quantity specified in our applicable price list, we will not accept the order. We will inform you if this is the case.

The Company will identify material that requires each order to meet a minimum quantity (where such minimum exceeds the amount necessary to fulfill the firm purchase orders in place at the relevant time), and provide a list of such material to the Buyer on a monthly basis (within ten (10) days following receipt of the monthly updated purchase order and forecast). The Company will place orders for such minimum quantity material only upon the Buyer's approval and the Company will have no liability for delays in delivery occasioned by the Buyer's failure to approve in a timely manner. Upon approval, the Buyer agrees that it shall be responsible for all costs associated with the non-returnable material in the event such material is not used in accordance with the monthly purchase order and forecast upon which the order was placed.
