Common use of MEMBERSHIP MAINTENANCE Clause in Contracts

MEMBERSHIP MAINTENANCE. All present employees who are members of the Union shall remain members of the Union in good standing as a condition of employment, all present employees who are not members of the Union may become and remain members of the Union not later than the 8th day of the execution of this Agreement as a condition of employment, that all new employees may become and remain members of the Union not later than the 8th day after their respective hiring date as a condition of employment provided, however, that the Union shall comply with Labor-Management Relations Act of respect to Union Security and the Labor-Management Reporting Disclosure Act of 1959. It is further agreed that in the event any employee employed under the terms and conditions of this Agreement does not comply with the above section, the party of the second part shall notify the employer in writing requiring discharge of said employee. Provided, further that no Employer of the Union shall discriminate against any employee to whom membership was not available on the same terms and conditions generally applicable to other members of the Union, or if membership was denied the employee for reasons other than the failure of the employee to tender the periodic dues, assessments and the initiation fees, uniformly required as a condition of acquiring membership.
