Measured Usage. In the event that Tenant's use of the Premises includes the use of computers or other electrical equipment or fixtures causing, in Landlord's sole determination, Tenant's use of electric service to exceed the service to be provided under the first sentence of subparagraph 7(a)(ii) above, or if there shall be at the Premises any other hours (i.e. outside the hours specified in 7(b)(i)) use of electricity which Landlord believes may be material, Landlord shall install in the Premises or elsewhere, if Landlord shall so elect, or, if Tenant shall so request and if feasible in Landlord's reasonable judgment, one or more meters or other devices to measure the electricity used by such computers or other equipment or fixtures and/or such other hours use; and Tenant shall pay Landlord for such electricity within ten days after submission of each xxxx by Landlord therefor, at such rates as shall be from time to time determined by Landlord, provided that the rates charged by Landlord shall not exceed Landlord's cost (including, without limitation, taxes, fuel adjustment charges, and other like charges regularly passed on to customers by public utility companies and transformer costs) of supplying

Registry Operator’s emergency operations department shall be available at all times to respond to extraordinary occurrences.

  • Service Availability You understand that Service availability is at all times conditioned upon the corresponding operation and availability of the communication systems used in communicating your instructions and requests to the Credit Union. We will not be liable or have any responsibility of any kind for any loss or damage thereby incurred by you in the event of any failure or interruption of such communication systems or services resulting from the act or omission of any third party, or from any other cause not reasonably within the control of the Credit Union.
