Meal Breaks and Allowances. 22.1 An employee shall not be required to work for more than five hours without a break for a meal. Provided that by agreement between the Company and the majority of employees in the plant, work section or sections concerned, employees may be required to work in excess of five hours but not more than six hours at ordinary rates of pay without a meal break. 22.2 The time of taking a scheduled meal break or rest break by one or more employees may be altered by the Company if it is necessary to do so in order to meet a requirement for continuity of operations. 22.3 The Company may stagger the time of taking meal and rest breaks to meet operational requirements. 22.4 Subject to the provisions of sub-clause 22.1 hereof, an employee shall work during meal breaks at ordinary rates of pay whenever instructed to do so for the purpose of making good breakdown of plant or upon routine maintenance of plant which can only be done while such plant is idle. 22.5 Except as provided in sub-clauses 22.1 and 22.4 hereof, double time rates shall be paid for all work done during meal breaks and thereafter until a meal break is taken. 22.6 When an employee on day work is required to work overtime after the usual ceasing time for the day for two hours or more, he/she shall be allowed to take, without deduction of pay, a crib time of 30 minutes in duration immediately after such ceasing time and thereafter, after each four hours of continuous work, he/she shall be allowed to take also, without deduction of pay, a crib time of 30 minutes in duration. In the event of an employee remaining at work after the usual ceasing time without taking the crib time of 30 minutes and continuing at work for a period of two hours or more, he/she shall be regarded as having worked 30 minutes more than the time worked and be paid accordingly. 22.7 A day worker working overtime (including overtime on Saturday, Sunday or Public Holiday) shall be allowed a meal break of thirty minutes without deduction of pay after each four hours of overtime worked where the overtime is to be continued after such meal break, at a time which will ensure the efficient operation of work and meet the reasonable needs of the employee. 22.8 A meal break shall not be regarded as time worked for the purpose of determining when the next meal break falls due. 22.9 Shift Workers 22.9.1 Each shift of more than four hours' duration shall include a meal break of thirty minutes which shall be taken so as not to interfere with the continuous operation of the plant and or equipment 22.9.2 A shift worker shall not be required to work for more than five hours without taking a meal break. Provided that where in order to ensure the continuous operation of plant or equipment, meal breaks need to be staggered or flexible arrangements made, employees may be required to work in excess of five hours but not more than six hours at ordinary rates of pay without taking a crib time. 22.9.3 A shift worker required to work overtime of 1.1/2hrs or more before commencing or after completing a shift shall be entitled to a meal break at a time which will ensure the efficient operation of work and meet the reasonable needs of the employee. Meal Allowances - All Employees 22.10 An employee who does not go home for his/her meal, who is required to work overtime shall be supplied with a meal by the Company when the meal break falls due during such overtime, or be paid $12.40 in lieu thereof. The amount of $12.40 prescribed above shall be increased with effect from, and by the same percentage as future wage adjustments provided for in this Agreement. The provisions of this sub-clause shall not apply to overtime worked in accordance with an employee's shift roster. Rest times as prescribed by Clause 19 (Rest Time) are not regarded as meal breaks or crib times for the purpose of this sub-clause.

Meal Breaks and Allowances. 22.1 An employee shall not be required (a) All Monday to Friday dayworkers who work for more than five hours without a break for a meal. Provided that where in order to ensure the continuous operation of plant or equipment, meal breaks need to be staggered or flexible arrangements made, employees then staff may be required used to work in excess of five hours but operate the Plant while a relief employee is being obtained or is not more than six hours at ordinary rates of pay without taking a crib timeavailable. 22.9.3 A shift worker (f) An employee required to work overtime of 1.1/2hrs or for more before commencing or after completing a shift shall be entitled to a meal break at a time which will ensure the efficient operation of work than 2 hours on any one day and meet the reasonable needs who was not notified of the employee. Meal Allowances - All Employees 22.10 An employee who does not go home for his/her meal, who is required to work overtime shall requirement within 24 hours of the shift commencing will be supplied with a meal by the Company when the and in cases where a meal is not provided, a meal allowance will be paid as set out in Appendix A. (h) An employee will be allowed a paid refreshment break of 10 minutes in lieu thereofthe first half of ordinary hours worked on each day, to be taken to suit the needs of the operation. (i) The half an hour paid meal break will not be paid when an employee does not attend work. For example, the paid meal break will not apply when an employee is on paid or unpaid leave. (j) It is expected that the inclusion of a paid half an hour meal break for yard workers will provide an increase in flexibility to the business. Additionally, the yard employees will strive for productivity gains as per below: (i) Yard controlled waiting time will amount to less than 14.5 hours per month, calculated on a 12 monthly average. Yard controlled waiting time will include waiting for meal breaks, waiting for product to be found and yard other (to be agreed in consultation); and (ii) Yard errors will amount to a maximum of 1 error per month on a 12-month average basis. Such yard errors will include loading of incorrect product, loading incorrect quantity and product not being loaded. (iii) The amount abovementioned productivity gains will be reviewed at the end of $12.40 prescribed above shall be increased with effect fromthe life of this Agreement, and by if the same percentage as future wage adjustments provided for in this Agreement. The provisions of this sub-clause shall not apply to overtime worked in accordance with an employee's shift roster. Rest times as prescribed by Clause 19 (Rest Time) productivity gains are not regarded as being sustained then the Company may make any adjustments necessary, including removing the paid meal breaks or crib times for breaks. If this occurs, the purpose hours referred to in clause 6(b) and hours outside of this sub-clause6am-6pm in clause 6(a) will no longer apply.
