Materials Escalation Clause Samples

Materials Escalation. ▇▇▇▇ may seek additional costs for escalation of materials after the establishment of the GMP, if, and only if, ▇▇▇▇ demonstrates all the following conditions are satisfied: (1) Condition 1. ▇▇▇▇ establishes that the escalation was caused by: (i) a force majeure as identified in the General Conditions; or (ii) an event that would qualify as a delay for which ▇▇▇▇ is entitled to additional compensation; (2) Condition 2. The escalated cost did not result from any action of ▇▇▇▇, including, without limitation, failing to properly or diligently plan, sequence, schedule, or coordinate the Services; materials at issue; (3) Condition 3. ▇▇▇▇ timely ordered and/or purchased the (4) Condition 4. ▇▇▇▇’▇ material costs, as reflected in Subcontractor bids, were reasonable at the time that ▇▇▇▇ solicited subcontractors during the Subcontractor Procurement Process;
