MATERIAL SAMPLES. 6.6.1 The Contractor shall furnish all samples required by the drawings and specifications or that may be requested by the Project Manager of any and all materials or equipment it proposes to use. Unless specifically required, samples are not to be submitted with the bid. 6.6.2 No materials or equipment of which samples are required shall be used on the work until the Project Manager has received and accepted the samples. If the Contractor proceeds to use such materials before the Project Manager accepts the samples, the Contractor shall bear the risk. 6.6.3 Contractor shall furnish two (2) copies of a transmittal letter with each shipment of samples. The letter shall provide a list of the samples, the name of the building or work for which the materials are intended and the brands of the materials and names of the manufacturers. Also, each sample submitted shall have a label indicating the material represented, its place of origin, the names of the producer, the Contractor and the building or work for which the material is intended. Samples of finished materials shall be marked to indicate where the materials represented are required by the drawings or specifications. 6.6.4 Acceptance of any sample(s) shall be only for the characteristics or for the uses named in such acceptance and for no other purpose. Acceptance of samples shall not change or modify any contract requirement. All samples will be provided by the Contractor at no extra cost to the Department. See also Section 5.5,
MATERIAL SAMPLES. The same procedure shall be followed for any re-submittals. All shop drawings, material samples and submittal literature shall be properly identified with job name, product type, model number and certification stamp. All shop drawings, material samples and/or submittal literature must be mailed or hand-delivered to Contractor’s office. Contractor will not accept or process any submittals sent by facsimile. Any exceptions to the required submittal material must be requested in writing and authorized by Contractor before they are submitted to Contractor for Owner review.
MATERIAL SAMPLES. 3.14.1 The Design-Builder shall furnish for the written approval of the Engineer any samples required by the Contract Documents or that may be requested by the Engineer of any and all materials or equipment Design-Builder proposes to use to complete the Work. The Design-Builder shall not use any materials or equipment of which samples are required to be submitted until written approval has been given by the Engineer. 3.14.2 A letter in duplicate by the Design-Builder shall accompany each shipment of samples submitted and shall contain a list of the samples, the name of the building or work for which the materials or equipment are intended and the brands of the materials or equipment and names of the manufacturers. Samples of finished materials shall be so marked as to indicate where the materials are required by the Contract Documents. 3.14.3 The approval of any sample shall be only for the characteristics or for the uses named in such approval and for no other purpose. Approval of a sample shall not be construed as to change or modify any Contract Document requirement. 3.14.4 All samples will be provided by the Design-Builder at no extra cost to the City. 3.14.5 All materials and equipment approved by Design-Builder must be submitted to the City for record and final conformance review upon approval. Provide three (3) copies of each submittal with indications of approval by the Design-Builder’s architect of record and the Design-Builder. 3.14.6 It is understood that the City reserves the right to retest all material or equipment which have been tested and accepted at the source of supply after the same has been delivered to the Site and to reject all materials or equipment which, when retested, do not meet the requirements of the Contract Documents.
MATERIAL SAMPLES. If any of the Information delivered by Liquidmetal or its Representatives to Company consists of samples of amorphous alloys or samples of other materials (referred to as "Materials"), then Company shall not take or send the Materials to any location other than the facilities of the Company without the prior written consent of Liquidmetal. The Company acknowledges that the Materials may be experimental in nature and shall be used with prudence and appropriate caution. The Company will not engage in any testing or processing of the Materials (including, but not limited to, any grinding, melting, milling, or machining of the Materials) without the express prior written consent of Liquidmetal. In no event shall Liquidmetal be liable for any use by the Company or its Representatives for any loss, claim, damage, or liability, of any kind or nature, that may arise from or in connection with the use, handling, or storage of the Materials, and the Company agrees to indemnify and hold harmless Liquidmetal and Liquidmetal's Representatives from any liability, loss, or damage they may suffer as a result of claims, demands, costs, or judgments against them arising out of the use or disposition of the Materials by the Company.

MATERIAL SAMPLES. All materials believed by either party to be useful in the design of Products and prepared by such party in the course of any of its research under this Agreement will be discussed with the other party and samples of such materials will be submitted to the other party upon request.
MATERIAL SAMPLES. During the course of the work, the Project Representative shall be allowed to secure samples of the materials being used from the containers on the jobsite and submit them to an independent testing laboratory for comparison. All non-approved material installed or stored shall be removed from the construction site until it has been tested. Installed materials that do not conform to the Contract shall be removed at no additional cost to King County.   • MATERIAL SAFETY All manufacturers, importers, suppliers, or distributors of hazardous chemicals doing business in this State must provide a copy of the current Material Safety Data Sheet (MSDS) for any hazardous chemical to their direct purchasers of that chemical.

  • Material Safety Data Sheet The contractor shall provide Material Safety Data Sheets (MSDS) with the information required by the Act and the regulations for each hazardous substance or hazardous mixture. The Commonwealth must be provided an appropriate MSDS with the initial shipment and with the first shipment after an MSDS is updated or product changed. For any other chemical, the contractor shall provide an appropriate MSDS, if the manufacturer, importer, or supplier produces or possesses the MSDS. The contractor shall also notify the Commonwealth when a substance or mixture is subject to the provisions of the Act. Material Safety Data Sheets may be attached to the carton, container, or package mailed to the Commonwealth at the time of shipment.

  • MATERIAL SAFETY DATA SHEETS As applicable, Contractor shall provide Purchaser with all appropriate current Material Safety Data Sheets (“MSDS”) at the time of delivery of each shipment of Goods which requires such compliance and/or and for materials used by Contractor while performing Services pursuant to this Contract.
