Common use of March-in Rights Clause in Contracts

March-in Rights. (a) In the event the Government chooses to exercise its March-in Rights, as defined in Article VII, Section I of this Agreement, the Performer agrees, upon written request from the Government, to deliver at no additional cost to the Government, all Data necessary to achieve practical application within sixty (60) calendar days from the date of the written request. The Government shall retain Unlimited Rights, as defined in Attachment 4 of this Agreement, to this delivered Data.

March-in Rights. (a) In the event the Government chooses to exercise its March-in Rights, as defined in Article VII, “Patent Rights” Section I of this Agreement, the Performer Subcontractor agrees, upon written request from the GovernmentMEDIMMUNE, to deliver at no additional cost to the GovernmentMEDIMMUNE, all copies of Data necessary to achieve practical application within sixty (60) calendar days from the date of the written request. The MEDIMMUNE and Government shall retain Unlimited Rights, as defined in Attachment 4 Article I, Section B of this Agreement, to this delivered Data.

The Government shall retain Unlimited Rights, as defined in Attachment 4 of this Agreement, Rights to this delivered Data.
