Common use of Maintenance of Accounts Clause in Contracts

Maintenance of Accounts. (i) Maintain any deposit account or account holding securities owned by Borrower except accounts with respect to which Lender is able to take such actions as it deems necessary to obtain a perfected security interest in such accounts through one or more Account Control Agreements; or (ii) grant or allow any other Person (other than Lender) to perfect a security interest in, or enter into any agreements with any Persons (other than Lender) accomplishing perfection via control as to, any of its deposit accounts or accounts holding securities.

Maintenance of Accounts. (i) Maintain any deposit account or account holding securities owned by Borrower except accounts with respect to which Lender is are able to take such actions as it deems necessary to obtain a perfected security interest in such accounts through one or more Account Control Agreements; or (ii) grant or allow any other Person (other than LenderLender and Horizon) to perfect a security interest in, or enter into any agreements with any Persons (other than LenderLender and Horizon) accomplishing perfection via control as to, any of its deposit accounts or accounts holding securities.

(ia) Maintain any deposit account or securities account holding securities owned by Borrower (other than Excluded Accounts) except accounts with respect to which Collateral Agent and each Lender is able to take such actions as it deems necessary to obtain have obtained a perfected security interest in such accounts through one or more Account Control Agreements; Agreements or (iib) grant or allow any other Person (other than LenderCollateral Agent or Lenders) to perfect a security interest in, or enter into any agreements with any Persons (other than LenderCollateral Agent or Lenders) accomplishing perfection via control as to, any of its deposit accounts or accounts holding securitiessecurities accounts.

(i) Maintain any deposit account or account holding securities owned by Borrower except accounts with respect to which Lender is Lenders, or if requested by Lenders, one of the Lenders, as agent for Lenders, are able to take such actions as it deems they deem necessary to obtain a perfected security interest in such accounts through one or more Account Control Agreements; or (ii) grant or allow any other Person (other than LenderLenders) to perfect a security interest in, or enter into any agreements with any Persons (other than LenderLenders) accomplishing perfection via control as to, any of its deposit accounts or accounts holding securities.

(i) Maintain any deposit account accounts or account accounts holding securities owned by Borrower except accounts with respect to which Lender is able to Lenders take such actions action as it deems they deem necessary to obtain a perfected security interest in such account, provided that, Borrower shall use commercially reasonable efforts to deliver to Lenders account control agreement(s) for such accounts through one or more Account Control Agreements; or (ii) grant or allow any other Person (other than Lender) in a timely fashion and in such forms as are reasonably acceptable to perfect a security interest in, or enter into any agreements with any Persons (other than Lender) accomplishing perfection via control as to, any of its deposit accounts or accounts holding securitiesLenders and Borrower.
