Common use of Listing Market Clause in Contracts

Listing Market. IHK shall promptly prepare and submit to the American Stock Exchange or such other stock exchange or market as the parties reasonably agree (the "Listing Market") a listing application covering the shares of IHK Common Stock to be issued in the Merger and pursuant to Substitute Options, and shall use commercially reasonable efforts to obtain, prior to the Effective Time, approval for the listing of such IHK Common Stock, subject to official notice to the Listing Market of issuance, and the Company shall cooperate with IHK with respect to such listing.
