Common use of Limited Remedy Clause in Contracts

Limited Remedy. If the Services or Deliverables do not meet the warranty as provided in Section 5.1, Tricentis will make commercially reasonable efforts to correct the nonconformity causing the warranty failure in the Services or Deliverables. For any breach of the warranty in Section 5.1, Customer’s exclusive remedy will be as described in this Section 5.3.

Limited Remedy. If the Services or Deliverables do not meet the warranty as provided in Section 5.16.1, Tricentis will make commercially reasonable efforts to correct the nonconformity causing the warranty failure in the Services or Deliverables. For any breach of the warranty in Section 5.16.1, Customer’s exclusive remedy will be as described in this Section 5.36.3. Where Tricentis cannot correct any nonconformity, Tricentis limits its liability to Customer for breach of the warranty in Section 6.1 under the ACL to (at Tricentis’s election) the re-supply of the Services or payment of the cost of resupplying the Services.
