Common use of Limitation of Guaranty Clause in Contracts

Limitation of Guaranty. To the extent that any court of competent jurisdiction shall impose by final judgment under applicable law (including the applicable state law and §§ 544 and 548 of the Bankruptcy Code) any limitations on the amount of any Guarantor’s liability with respect to the Guaranteed Obligations which any Guaranteed Party can enforce under this Guaranty, the Guaranteed Parties by their acceptance hereof accept such limitation on the amount of such Guarantor’s liability hereunder to the extent needed to make this Guaranty fully enforceable and nonavoidable.

Limitation of Guaranty. To the extent that any United States court of competent jurisdiction shall impose by final judgment under applicable law (including the applicable state law and §§ sections 544 and 548 of the United States Bankruptcy Code) any limitations on the amount of any Guarantor’s 's liability with respect to the Guaranteed Obligations which any Guaranteed Party the Agent or the Lenders can enforce under this Guarantysection 5, the Guaranteed Parties Agent and the Lenders by their acceptance hereof accept such limitation on the amount of such Guarantor’s 's liability hereunder to the extent needed to make this Guaranty section 5 fully enforceable and nonavoidable.

Limitation of Guaranty. To the extent that any court of competent jurisdiction shall impose by final judgment under applicable law Laws (including the applicable state law and §§ sections 544 and 548 of the Bankruptcy Code) any limitations on the amount of any Subsidiary Guarantor’s liability with respect to the Guaranteed Obligations which any Guaranteed Party that Agent can enforce under this GuarantySection 11.19, the Guaranteed Parties Agent and each Lender by their acceptance hereof accept such limitation on the amount of such Subsidiary Guarantor’s liability hereunder to the extent needed to make this Guaranty Section 11.19 fully enforceable and nonavoidable.

Limitation of Guaranty. (i) To the extent that any court of competent jurisdiction shall impose by final judgment under applicable law (including the applicable state law and §§ §544 and 548 of the Bankruptcy Code) any limitations on the amount of any a Guarantor’s liability with respect to the Guaranteed Obligations which any Guaranteed Party can enforce under this Guaranty, the Guaranteed Parties by their acceptance hereof accept such limitation on the amount of such Guarantor’s liability hereunder to the extent needed to make this Guaranty and the Guarantor Documents fully enforceable and nonavoidable.

Limitation of Guaranty. To the extent that any court of competent jurisdiction shall impose by final judgment under applicable law (including the applicable state law and §§ 544 and 548 of the Bankruptcy Code) any limitations on the amount of any the Guarantor’s liability with respect to the Guaranteed Obligations which any Guaranteed Party the Buyer can enforce under this Guaranty, the Guaranteed Parties Buyer by their its acceptance hereof accept accepts such limitation on the amount of such Guarantor’s liability hereunder to the extent needed to make this Guaranty and the Notes fully enforceable and nonavoidable.

To the extent that any court of competent jurisdiction shall impose by final judgment under applicable law (including the applicable state law Uniform Fraudulent Transfer Act and §§ Sections 544 and 548 of the United States Bankruptcy Code) any limitations on the amount of any Guarantor’s liability with respect to the Guaranteed Obligations which any Guaranteed Party Lender can enforce under this Guaranty, the Guaranteed Parties by their acceptance hereof accept Lender accepts such limitation on the amount of such Guarantor’s liability hereunder to the extent needed to make this Guaranty and Guarantor Documents fully enforceable and nonavoidable.

Limitation of Guaranty. Limitation of Guaranty. To the extent that any court of competent jurisdiction shall impose by final judgment under applicable law Laws (including the applicable state law and §§ sections 544 and 548 of the Bankruptcy Code) any limitations on the amount of any Subsidiary Guarantor’s liability with respect to the Guaranteed Obligations which any Guaranteed Party that Lender can enforce under this GuarantySection 11, the Guaranteed Parties Lender by their its acceptance hereof accept accepts such limitation on the amount of such Subsidiary Guarantor’s liability hereunder to the extent needed to make this Guaranty Section 11 fully enforceable and nonavoidable.

Limitation of Guaranty. Limitation of Guaranty. To the extent that any court of competent jurisdiction shall impose by final judgment under applicable law (including the applicable state law Uniform Fraudulent Transfer Act and §§ §544 and 548 of the United States Bankruptcy Code) any limitations on the amount of any Guarantor’s liability with respect to the Guaranteed Obligations which any Guaranteed Party the Bank can enforce under this Guaranty, the Guaranteed Parties by their acceptance hereof accept Bank accepts such limitation on the amount of such Guarantor’s liability hereunder to the extent needed to make this Guaranty and Guarantor Documents fully enforceable and nonavoidable.

Limitation of Guaranty. To the extent that any court of competent jurisdiction shall impose by final judgment under applicable law Laws (including the applicable state law and §§ sections 544 and 548 of the Bankruptcy Code) any limitations on the amount of any Subsidiary Guarantor’s liability with respect to the Guaranteed Obligations which any Guaranteed Party that Lender can enforce under this GuarantySection 10.4, the Guaranteed Parties Lender by their acceptance hereof accept such limitation on the amount of such Subsidiary Guarantor’s liability hereunder to the extent needed to make this Guaranty Section 10.4 fully enforceable and nonavoidable.
