Limit of the Employer’s Liability for Remittance or Payment of Payroll Deductions. 70 The Employer shall not be liable to the Union by reason of the requirements of this Agreement for the remittance of any sum other than that constituting actual deductions made from wages earned by Employees. 71 In the event 2012 Public Act 349 is repealed or rendered ineffective as a result of voter, final judicial determination (including the exhaustion of all available appeals), or legislative action, the provisions of Article IX, “Membership Dues and Service Fees”, contained in the 2013-2016 Collective Bargaining Agreement between EMU and the Union, shall become effective per the time frame established by such voter, judicial, or legislative action, so long as such provisions are in compliance with the law.
