Common use of Lien Waiver Clause in Contracts

Lien Waiver. To the extent permitted by law, Contractor hereby agrees to waive and does hereby waive any and all mechanics’ liens and right to lien in connection with the work, agrees not to file any such mechanics’ lien and agrees to look solely to County for payment for Services hereunder and not to the Site Owner. Contractor hereby agrees to include similar waiver provisions in each and every subcontract by which each subcontractor, to the extent permitted by law, waives any and all mechanics’ liens and right to lien in connection with the work. Proof of each subcontractor’s compliance shall be presented by Contractor to County upon request. Further, Contractor agrees to furnish to County prior to final payments a release and waiver of lien (“ROL”) properly executed by Contractor and/or all of its subcontractors/material providers for labor performed, and any materials incorporated therein. Such ROL must be in a form acceptable to County. Failure by Contractor to comply with this Section shall be considered a default under this Agreement.
