Common use of Licensed Product Clause in Contracts

Licensed Product. The term "Licensed Product" shall mean any product which cannot be developed, manufactured, offered for sale, imported, used or sold without (i) infringing one or more claims under Scripps Patent Rights; or (ii) utilizing any part of Scripps Technology not otherwise included within Scripps Patent Rights.

Licensed Product. The term "Licensed Product" shall mean any product or process which cannot be developed, manufactured, offered for sale, imported, used or sold without (i) infringing one or more claims under Scripps Patent Rights; Rights or (ii) utilizing any part of Scripps Technology not otherwise included includable within Scripps Patent Rights.

For clarification, used or sold without (i) infringing one or more claims under a humanized version of the Scripps Patent Rights; or (ii) utilizing any part of Scripps Technology not otherwise included within Scripps Patent RightsProperty is considered a Licensed Product.

Licensed Product. The term "Licensed Product" shall mean any product which cannot be developed, manufactured, offered for sale, imported, used or sold without (i) infringing one or more claims under Scripps Patent Rights; or (ii) utilizing any part of Scripps Technology not otherwise included within Scripps Patent Rights; (iii) utilizing Licensed Software, Derivative Work, or Enhancement or any portion thereof, alone or in combination with other software and/or technology; or (iv) any other product made utilizing a Licensed Right.

The term "Licensed Product" shall mean any research, diagnostic, preventative or therapeutic product or process which cannot be developed, manufactured, offered for sale, imported, used or sold without (i) infringing one or more claims under utilizing Scripps Patent Rights; or (ii) utilizing , any part of Scripps Technology not otherwise included includable within Scripps Patent RightsRights or Jointly Developed Technology.

The term "“Licensed Product" ” shall mean any product which cannot be developed, manufactured, offered for sale, imported, used or sold without (i) infringing one or more claims Valid Claims under Scripps Patent Rights; or (ii) utilizing any part of Scripps Technology not otherwise included within Scripps Patent Rights.

The term "“Licensed Product" ” shall mean any product which cannot be developed, manufactured, offered for sale, imported, used or sold without (i) infringing one or more claims under utilizing Scripps Patent Rights; , or (ii) utilizing without using any part of Scripps Proprietary Property as related to Scripps Technology not otherwise included includable within Scripps Patent Rights.

The term "“Licensed Product" ” shall mean any product which that cannot be developed, manufactured, offered for to sale, importedused, used sold or sold imported without (i) infringing one or more issued claims under Scripps Patent Rights; or (ii) utilizing any part of Scripps Technology not otherwise included within Scripps Patent Rights.

The term "Licensed Product" shall mean any research, diagnostic, preventative or therapeutic product or process which cannot be developed, manufactured, offered for sale, imported, used or sold without (i) infringing one or more claims under utilizing Scripps Patent Rights; or (ii) utilizing , any part of Scripps Technology not otherwise included includable within Scripps Patent RightsRights or Jointly Developed Technology. The term "Licensed Product" shall mean any product which (a) if made, used or sold absent the license granted hereby would infringe the valid claim of one or more valid issued patent(s) included within the Scripps Patent Rights, or (b) cannot be developed, manufactured, offered for sale, imported, used or sold without (i) infringing one or more claims under Scripps Patent Rights; or (ii) utilizing any part of the Scripps Technology not otherwise included within Scripps Patent RightsTechnology.
