Common use of Lessor Indemnification Clause in Contracts

Lessor Indemnification. Lessor and its successors and assigns shall indemnify, defend, reimburse and hold Lessee, its agents, employees and lenders, harmless from and against any and all environmental damages, liabilities, judgements, claims, expenses, penalties, and attorneys' and consultants' fees, including the cost of remediation, as a result of Hazardous Substances on the Premises prior to the Start Date or which are caused by the gross negligence or willful misconduct of Lessor, its agents or employees. Lessor's obligations, as and when required by the Applicable Requirements, shall include, but not be limited to, the cost of investigation, removal, remediation, restoration and/or abatement, and shall survive the expiration or termination of this Lease.

Lessor Indemnification. Lessor and its successors and assigns shall indemnify, defend, reimburse and hold Lessee, its agents, employees and lenders, harmless from and against any and all environmental damages, liabilities, judgements, claims, expenses, penalties, and attorneys' and consultants' fees, including the cost of remediation, which are suffered as a direct result of Hazardous Substances on the Premises prior to the Start Date Lessee taking possession or which are caused by the gross negligence or willful misconduct of Lessor, its agents or employees, or which constitute a Lessor misrepresentation pursuant to Paragraph 6.2(h). Lessor's ’s obligations, as and when required by the Applicable Requirements, shall include, but not be limited to, the cost of investigation, removal, remediation, restoration and/or abatement, and shall survive the expiration or termination of this Lease.

Lessor's obligations, as and when required by the Applicable Requirements, shall include, but not be limited to, the cost of investigation, removal, remediation, restoration and/or abatement, and shall survive the expiration or termination of this Lease.

Lessor Indemnification. Lessor and its successors successor and assigns shall indemnify, defend, reimburse and hold Lessee, its agents, employees and lenders, harmless from and against any and all environmental damages, liabilities, judgements, claims, expenses, penalties, and attorneys' and consultants' fees, including the cost of remediation, which existed as a result of Hazardous Substances on the Premises prior to the Start Commencement Date or which are caused by the gross negligence or willful misconduct of Lessor, its agents or employees, or which migrate or migrated onto the Premises from adjacent properties. Lessor's obligations, as and when required by the Applicable Requirements, shall include, but not be limited to, the cost of investigation, removal, remediation, restoration and/or abatement, and shall survive the expiration or termination of this Lease.
