Common use of Lead-Based Paint Assessment Clause in Contracts

Lead-Based Paint Assessment. If Buyer elects to conduct or obtain a risk assessment or inspection of the 535 Property for the presence of Lead-Based Paint or Lead-Based Paint hazards, Buyer has a Right to Terminate under § 25.1 by Seller’s 536 receipt of Xxxxx’s Notice to Terminate on or before the expiration of the Lead-Based Paint Termination Deadline. If Buyer’s 537 Notice to Terminate would otherwise be required to be received by Seller after Closing Date, Xxxxx’s Notice to Terminate must be 538 received by Seller on or before Closing. Buyer may elect to waive Buyer’s right to conduct or obtain a risk assessment or inspection 539 of the Property for the presence of Lead-Based Paint or Lead-Based Paint hazards. If Seller does not receive Xxxxx’s Notice to 540 Terminate within such time, Xxxxx accepts the condition of the Property relative to any Lead-Based Paint as satisfactory and Buyer 541 waives any Right to Terminate under this provision.
