Common use of Layoff Overview Clause in Contracts

Layoff Overview. (a) A layoff means a reduction of positions in the bargaining unit in any classification within a unit. The Employer will determine the number of positions to be reduced in each classification, in each unit, and on each shift. An employee about to be indefinitely laid off will be given seven (7) days advance notice or, in lieu thereof, wages (s)he would have earned during the seven (7) day period but for the layoff. For informational purposes, the Union will receive a copy of the layoff notice and a list which contains the classifications, status, department, unit and shift where the layoff is to occur. (b) A layoff may be for a temporary period of time of thirty (30) calendar days. Any layoff designated as temporary will be deemed indefinite as of the 31st calendar day. Temporary layoffs will not be used in lieu of discipline or indefinite layoffs. Temporary layoffs will not be used in a unit that is using per diems or Agency Nurses on that shift. Employees will not have bumping rights during a temporary layoff.
