Common use of Laborers Clause in Contracts

Laborers. All workmen, subcontractors, laborers or any person working on the Project shall only have contractual privity with the Contractor and not the Owner, and the Owner understands and agrees that the Owner shall have no right of control over any such workmen, subcontractors or laborers. Contractor has complete discretion over all material purchased for the Project, so long as same is consistent with the plans and specifications. All purchases made by the Owner must be coordinated through the Contractor. The Contractor shall not be held responsible or liable for the actions or omissions of any of the contractors contracted by the Owner, prior Prime contractors or others to perform the work or provide construction or design services prior to the date hereof, and any damage to persons or property caused or resulting thereby, whether actual or latent and whether discovered prior to the completion of the work or in the future.
