Involuntary Transfers/Reassignments. 1. Qualified applicants for vacancies may be considered for vacant positions prior to the involuntary transfer/reassignment of any bargaining unit members.
2. A member being involuntarily transferred/reassigned will only be placed in a position for which the member is certified.
3. Any member being involuntarily transferred/reassigned shall be notified in writing of such transfer/reassignment. Within fifteen (15) days of notice, such teacher shall be granted a conference, upon written request, with the Superintendent and building principal who shall give reasons for such reassignment/transfer.
4. The Superintendent shall have the authority to involuntarily transfer/reassign provided the teacher is given written notice, reasons, and the opportunity for a conference as set forth in paragraph C-3 above.
5. No involuntary transfer/reassignment shall be arbitrary, capricious or disciplinary in nature.
Involuntary Transfers/Reassignments. Involuntary or forced transfers will be minimized and avoided whenever possible.
Involuntary Transfers/Reassignments. An involuntary transfer is a transfer not initiated by the unit member.
7.4.1 Involuntary transfer/reassignment shall be made only for the following reasons:
7.4.1.1 A decrease in the number of pupils which requires a decrease in the number of unit members due to elimination of program(s) and/or funding.
7.4.1.2 To meet educational program requirements.
7.4.1.3 A school closing. The following sequence shall be followed if the above occurs:
7.4.2 If a decrease in the number of pupils, elimination of programs, and/or funding occurs, credentials, program needs, and seniority shall be used to identify unit members who may be involuntarily transferred/reassigned.
7.4.2.1 There shall be an immediate freeze of all positions at all sites. No change of assignment, grade level, subject area, or position shall occur throughout the process, with the exception of combination or multi-age classes in elementary and secondary unit members in multiple departments.
7.4.2.1.1 If a combination or multi-age class is eliminated, the unit member of that class shall begin the placement process at Article 7.4.2.2.
7.4.2.1.2 If a combination or multi-age class is dissolved into one of it’s component grade levels, the unit member from the combination or multi-age class shall fill that component grade level position.
7.4.2.1.3 If a combination or multi-age class is divided into two or more classes of its original component grade levels, the unit member from the original combination or multi-age position shall choose one of the newly created component positions.
7.4.2.1.4 If a combination or multi-age class(es) at a site is established and a grade level component(s) of the above combination or multi-age class(es) is being eliminated at the same site,
7.4.2.1.4.1 The District shall ask for a volunteer(s) from the grade level component(s) being eliminated to fill the combination or multi-age class(es). If there are more volunteers than positions, the most senior volunteer(s) shall have the choice.
7.4.2.1.4.2 If there are no volunteers, then the
7.4.2.1.5 If a secondary unit member is in multiple departments and/or at multiple sites, he/she shall have seniority rights in each department he/she teaches and if applicable at each site he/she teaches.
7.4.2.1.5.1 If sections are being eliminated in one (1) or more departments that a unit member is in, and no sections are being established in the department a unit member is in, then that unit member shall begin the placement process at Artic...
Involuntary Transfers/Reassignments. 18.6.1 Involuntary transfers and reassignments shall not be punitive or disciplinary and shall be based upon the legitimate educational needs of the County, which include:
18.6.1.1 Reorganization of a school site or track;
18.6.1.2 Special curriculum needs at a school site or on a track;
18.6.1.3 Welfare of the educational program;
18.6.1.4 Criteria set forth under paragraph 4.5.
18.6.2 The County Superintendent has final authority in determining involuntary transfers and reassignments.
18.6.3 For any unit member required to transfer sites, classrooms, or programs, the County Office will work with the unit member to determine any amount of compensated time, at their current hourly rate, needed for relocation. In addition, PCOE may secure a substitute teacher to take the place of the unit member so that preparation may occur during the regular work day.
Involuntary Transfers/Reassignments. 11.6.1. Transfers/Reassignments shall not be punitive or disciplinary in nature.
11.6.2. Transfers/Reassignments shall be based exclusively on the legitimate educational and financial needs of the District and credentialing to perform the required services.
11.6.3. If no voluntary transfer/reassignment has occurred as a result of the posted vacancies, unit members to be transferred/reassigned shall be selected on the basis of mutual discussion between the affected unit member and the administration with the final decision resting with the Superintendent.
11.6.4. No unit member shall be required to transfer/reassign involuntarily two (2) years in a row.
Involuntary Transfers/Reassignments. 15.3.1 Unit members may be transferred / reassigned involuntarily at the District’s discretion based on the needs of the District and its pupils.
15.3.2 If a decrease in the number of pupils or the elimination of programs and / or funding occurs, the District shall seek volunteers prior to making any involuntary transfer / reassignment. The District retains discretion to determine that an involuntary transfer is necessary for reasons other than decrease in pupils, elimination of programs and / or funding.
15.3.3 Involuntary transfers may not be made arbitrarily or capriciously and will be made for the following reasons:
a. For reasons of administrative necessity to mitigate curriculum, program, or staffing problems.
b. To mitigate staff performance or relations problems
c. To better utilize instructional resources when needed to serve the best interests of the affected schools and their pupils.
15.3.4 Involuntary transfers and reassignments shall be preceded by a meeting if requested by the unit member. The meeting shall be held between the unit member and the Superintendent or designee for purposes of explanation. Upon request the District will provide the reasons for the transfer in writing at the meeting. The unit member may bring an Association representative.
15.3.5 Upon request, the District shall move a unit member’s materials whenever a unit member is involuntarily transferred or reassigned.
15.3.6 Upon notification of transfer to a different grade level, the unit member will be given an opportunity to observe in a classroom similar to the new assignment for one (1) day. Observation days will be separate from the preparation days referenced in 15.3.9.
15.3.7 Unit members will have four hundred dollars ($400) added to their classroom budget to acquire additional instructional materials, supplies, and equipment.
15.3.8 Notice of involuntary transfers/reassignments will take place by May 1 for the following school year, unless unforeseen circumstances, i.e., resignation, retirement, facility issue, etc., dictate shorter notice. This provision will commence with transfers/reassignments for the 2021-2022 school year.
15.3.9 Upon request the unit member shall be granted four (4) days of preparation time when involuntarily transferred/reassigned during the school year.

Involuntary Transfers/Reassignments a. Involuntary transfers/reassignments will be made in accordance with provisions of Articles IX (Assignment and Reassignment), and XI (Transfers). If transfer becomes necessary under the terms of this Article, the District shall actively seek volunteers prior to making any involuntary transfer.
Involuntary Transfers/Reassignments. The involuntary transfer of certified staff member may become necessary due to pupil distribution, instructional requirements, a change in facilities, reductions in force, and/or other reasons. Certified staff being involuntarily transferred shall be given written notice prior to the transfer. Whenever possible, notification will be given within thirty (30) calendar days prior to the last day of the school year. At the written request of a certified staff member identified for transfer, a meeting will be held with the Superintendent or designee within ten (10) working days of the notification to review the reasons for the reassignment/transfer. In the event a certified staff member is involuntarily reassigned/transferred, that fact shall be a consideration the following school year should that certified staff member apply for a voluntary transfer to a permanently vacated position, provided the individual meets the criteria outlined in paragraph 6.3.
Involuntary Transfers/Reassignments. 1. Involuntary transfers and reassignments shall not be punitive or disciplinary in nature and shall be based upon the legitimate educational needs of the District as follows:
1.1 Surplus of teachers at school site or grade level;
1.2 Reorganization of a school site;
1.3 Special curriculum needs at school site;
1.4 Welfare of the educational program;
1.5 Criteria set forth under Paragraph C.3 of this Article.
1.6 If more than one (1) teacher is determined to be equal in being able to meet the legitimate educational needs of the District based upon the above, the teacher with the least District seniority shall be selected for the vacancy.
2. The Superintendent has final authority in determining involuntary transfers and reassignments. If the Superintendent is unable to articulate why the legitimate educational needs of the District will not be met by transferring or reassigning the least senior teacher at the affected site or grade level, the least senior teacher at the affected site or grade level shall be transferred or reassigned.
Involuntary Transfers/Reassignments. 13.6.1 If the District determines that it must make an involuntary transfer/reassignment, the teaching staff will have three (3) teacher contract days to attempt to develop a mutually agreeable solution to fill the position.
13.6.2 An Involuntary Transfer/Reassignment shall be made by the School Principal or his/her designee on the basis of a vacancy or program need.
