Interconnection Facilities Study Agreement. Within fourteen (14) Calendar Days after receipt of the final Interconnection System Impact Study report, Interconnection Customer shall (a) narrow the scope to one level of generation output , if not previously narrowed under Section 7.3.1, for completion of the Interconnection Facilities Study; (b) provide demonstration of Site Control of at least fifty percent (50%) of sufficient land area to support the size and type of Generating Facility proposed; (c) provide security in the form of a deposit or Letter of Credit to cover twenty-five percent (25%) of the cost of the proposed Interconnection Facilities and Network Upgrades to be funded by Interconnection Customer identified in the final Interconnection System Impact Study; and (d) provide one of the following: (i) the designation of the Generating Facility as a Network Resource; (ii) a Transmission Service Request, or written confirmation of intent to submit a Transmission Service Request within thirty (30) Calendar Days, for the amount of generation identified in the final Interconnection System Impact Study; or (iii) a written statement indicating that Interconnection Customer will proceed with the Interconnection Request without making a Transmission Service Request and therefore shall accept the risk of any Transmission System operating limits. 8.1.1 Within fourteen (14) Calendar Days after receipt of the information in Section 8.1, Transmission Provider shall provide to Interconnection Customer an Interconnection Facilities Study Agreement in the form of Appendix 4 to this GIP, and a non-binding good faith estimate of the cost and time for completing the Interconnection Facilities Study, to be referenced in the description of scope attached to the Interconnection Facilities Study Agreement. The Interconnection Facilities Study Agreement shall provide that Interconnection Customer shall compensate Transmission Provider for the actual cost of the Interconnection Facilities Study, and that Transmission Provider will draw on Interconnection 8.1.2 Interconnection Customer shall sign and return the Interconnection Facilities Study Agreement along with any additional deposit to Transmission Provider within fourteen (14) Calendar Days after its receipt, together with the required technical data and verification of compliance with the requirements set forth in Section 8.1. 8.1.3 In the event that Interconnection Customer is unable to meet the requirements of Section 8.1 within fourteen (14) Calendar Days after receipt of the final Interconnection System Impact Study report, Interconnection Customer may notify Transmission Provider in writing that it intends to defer executing the Interconnection Facilities Agreement. Interconnection Customer has a one-time right of deferral for a maximum of eighteen (18) months from the date it was to have met the requirements of Section 8.1.

8.1.2 shall provide to Interconnection Customer a non-binding good faith estimate of the cost and timeframe for completing the Interconnection Facilities Study. Interconnection Customer shall sign and return execute the Interconnection Facilities Study Agreement along with any additional deposit and deliver the executed Interconnection Facilities Study Agreement to Transmission Provider within fourteen thirty (1430) Calendar Days after its receipt, together with the with:
(1) Any required technical data data;
(2) Demonstration of one-hundred percent (100%) Site Control or demonstration of a regulatory limitation and verification applicable deposit in lieu of Site Control provided to Transmission Provider in accordance with section 3.4.2 of this LGIP; and
(3) An additional deposit that brings the total Commercial Readiness Deposit submitted to Transmission Provider to ten percent (10%) of Interconnection Customer’s Network Upgrade cost assignment identified in the Cluster Study or Cluster Restudy, if applicable, in the form of an irrevocable letter of credit, cash, a surety bond, or other form of security that is reasonably acceptable to Transmission Provider. Transmission Provider shall refund the deposit to Interconnection Customer upon withdrawal in accordance with Section 3.7 of this LGIP. Interconnection Customer shall promptly inform Transmission Provider of any material change to Interconnection Customer’s demonstration of Site Control under Section 3.4.2(iii) of this LGIP. Upon Transmission Provider determining separately that Interconnection Customer no longer satisfies the Site Control requirement, Transmission Provider shall notify Interconnection Customer. Within ten (10) Business Days of such notification, Interconnection Customer must demonstrate compliance with the requirements set forth in Section 8.1.
8.1.3 In the event that Interconnection Customer is unable applicable requirement subject to meet the requirements of Section 8.1 within fourteen (14) Calendar Days after receipt of the final Interconnection System Impact Study reportTransmission Provider’s approval, Interconnection Customer may notify not to be unreasonably withheld. Absent such demonstration, Transmission Provider in writing that it intends shall deem the subject Interconnection Request withdrawn pursuant to defer executing the Interconnection Facilities Agreement. Interconnection Customer has a one-time right Section 3.7 of deferral for a maximum of eighteen (18) months from the date it was to have met the requirements of Section 8.1this LGIP.

a. Letter of Credit or payment of Interconnection Customer’s share of estimated Network Upgrades less any amounts provided under Section 7.2.f.i (refundable if LGIA is not executed by Interconnection Customer); or
b. An executed contract (or comparable evidence) for the sale of electric energy or capacity from the Generating Facility; or
c. Statement signed by an officer or authorized agent of the Interconnection Customer attesting that the Large Generating Facility is included in an applicable state resource plan; or
d. Other information that the Transmission Provider deems to be reasonable evidence that the Large Generating Facility will qualify as a designated Network Resource; or
e. Site Specific Purchase Order for generating equipment specific to Queue Position or statement signed by an officer or authorized agent of the Interconnection Customer attesting that the Generating Facility is to be supplied with the requirements set forth in Section 8.1.
8.1.3 In the event that turbines with a manufacturer’s blanket purchase agreement to which Interconnection Customer is unable a party. This blanket purchase agreement shall be provided to meet the requirements of Section 8.1 within fourteen (14) Calendar Days after receipt of the final Interconnection System Impact Study report, Transmission Provider.
7.7.1 Transmission Provider shall invoice Interconnection Customer may notify Transmission Provider in writing that it intends on a monthly basis for the work to defer executing be conducted on the Interconnection Facilities AgreementStudy.
