Common use of Installation, Maintenance and Other Services Clause in Contracts

Installation, Maintenance and Other Services. a. Except as otherwise expressly stated in this Agreement, the Customer is responsible for the prompt installation and proper maintenance of all Equipment and Software in accordance with Seller’s published instructions and good engineering practice. The Customer also shall employ sufficient technically qualified personnel and have available the proper equipment necessary for maintenance. Seller’s warranty of Equipment and Software furnished under this Agreement is conditioned on such prudent practices on the Customer’s part.
