Common use of Inspection of Facilities Clause in Contracts

Inspection of Facilities. District agrees that ENGIE Services U.S. will have the right, with or without prior notice, to inspect the Facilities to determine if District has consistently complied with its obligations as set forth above. If any inspection discloses that District has failed, on or prior to the date of such inspection, to be in compliance with any of its obligations, then the Guaranteed Savings will be assumed to have been achieved for the portion of the Energy Savings Term during which such failure will have existed.
