Common use of Initial Installation Clause in Contracts

Initial Installation. FIS shall deliver to Client the initial Copies of the Solution stated in the Order by supplying such initial Copies: (a) by physical shipment, such as on a disc or other media; or (b) by electronic delivery, such as by posting it on FIS’ network for downloading. Physical shipment is on F.O.B. terms, FIS’ shipping point and electronic delivery is deemed effective at the time FIS provides Client with access to download the Solution. The date of such delivery shall be referred to as the “Delivery Date.”
