Common use of INDEPENDENT CAPACITY OF THE CONTRACTOR Clause in Contracts

INDEPENDENT CAPACITY OF THE CONTRACTOR. 1. In the process of executing the terms and conditions stipulated in this contract, it is agreed between the parties that the Sub-recipient is an independent contractor and therefore solely liable for the performance of all tasks and activities detailed in the contract which are not the exclusive responsibility of the Coalition and/or the Office of Early Learning. The Sub-recipient shall be deemed capable and responsible for the hiring, firing and reprimanding of any and all employees engaged by the Sub-recipient to deliver the services and tasks outlined in this contract.
