Common use of Incorporation into Agreement Clause in Contracts

Incorporation into Agreement. Intel and Aquantia (the “Parties”) agree that this Project Statement #4 (“Project Statement”) will be attached to and incorporated in the “Agreement” as Attachment Number #4. For purposes of this Project Statement #4, the “Agreement” means the Master Purchase Agreement between Intel Corporation and Aquantia Corporation dated January 15, 2009, as amended to-date. The purpose of this Project Statement #4 is to set forth the terms and conditions under which Aquantia shall meet Intel [*] requirements and deliver the 10GbE Dual Port MAC/PHY device (“[*] Product”). The Parties agree that the date of this Project Statement #4 shall be November 8, 2012. [*] Any changes to the specifications of [*] Dual Port Product that are set forth in this Project Statement #4 must be agreed to by the Parties in writing.
