Common use of Incidence Clause in Contracts

Incidence. (i) This Agreement will replace the Office of Environment and Heritage (NSW) Flight Operations Enterprise Agreement 2017. (ii) This Agreement does not affect the terms and conditions of employment regulated by the following industrial instruments as varied, except where specifically varied by this Agreement: ◾ Crown Employees (Public Service Conditions of Employment) Reviewed Award 2009; ◾ Crown Employees (Transferred Employees Compensation) Award 2009; ◾ Government Sector Employment Act 2013; ◾ Government Sector Employment Regulation 2014; and ◾ Government Sector Employment Rules 2014. (iii) The parties agree that the hourly rate of pay for ordinary hours of work provided for by this Agreement shall not, at any time, be less than those provided for by the industrial instrument that would cover the employee, had this Agreement not been made.
