Incarceration. The Company will grant a leave of absence of up to ninety (90) days to any employee who is convicted of an offence arising out of the operation of a motor vehicle, on a one time basis only, or if the employee is held in custody pending disposition of any charges, provided the employee notifies the Company of the intended absence during the time periods set out in paragraphs 11.03(a)(iii) or (iv), whichever is appropriate. Requests for leave for incarceration or custody shall only be made pursuant to this sub-article. Nothing in this article shall prevent the Company from imposing discipline where appropriate.
