Incarceration. If an employee is incarcerated and later found not guilty, the employee will maintain their original seniority date for a period of one (1) year following their last day of work. If the Employer fills the employee’s position during their incarceration, the employee may not bump the employee who filled the position but will maintain seniority bidding rights for open positions as they become available in accordance with Article 14, Section 14.2(b). The employee is responsible for providing updated contact information to the Employer to ensure the Employer can contact them about open positions. No benefits will accrue while an employee is not working, however the employee will not be required to re-establish their initial eligibility for benefits once they return to work.
